This privacy policy (the “Policy”) is intended to inform customers and their members of the types of information about them (“Personal Information”) Checklick Inc. (“Checklick”, “we” or “us”) collects directly from its users and customers, as well as our policies and practices regarding the collection, use, and disclosure of that information through our web-based skill development platform and payment platform (“Checklick Storefront”), our web pages, and our other services provided by Checklick (collectively the “Services”).

We reserve the right to change this Policy at any time. Your continued use of any of our Services following the posting of changes to this Policy means that you accept those changes. We encourage you to review this Policy from time to time to make sure that you understand how any Personal Information about you will be collected, used, disclosed, and retained.

How Do We Collect, Use and Disclose Personal Information?

Personal Information Collected Through Your Use of the Site and Applications

Each time you visit the Site, we may collect information, including some of your Personal Information, by using cookies. A “cookie” is a piece of information that a website transfers to a user’s computer for the purpose of storing information about a user’s preferences.

You can set your Internet browser to refuse cookies, but some portions of the Site or our Services may not work properly if you refuse cookies. Each time you use one of our Applications, we may collect your mobile phone identifier and your geolocation.

We use cookies collected through the Site and our other websites to remember and recognize you when you visit those websites, identify you for login purposes, and improve your experience when using the Site.

We use your mobile phone identifier and geolocation to allow you to use the Applications and improve your experience in doing so. We will not disclose any of the Personal Information you provide to us through your use of the Site or Applications, such as cookies or geolocation information.

Personal Information You Voluntarily Provide to Us

To use Checklick, we require you to provide us with the following Personal Information:

  • First name
  • Last name
  • Valid email address
  • Your birthdate

We use this information to make it possible for us to uniquely identify you, and for other organizations using Checklick to uniquely identify you.

When you contact us, we may use your email address to contact you via email to respond to your inquiries, tell you about changes to this Policy, and inform you about our products or services in which you expressed an interest when you contacted us about our Services.

By using the Checklick Services, in accordance with applicable anti-spam legislation, you give us implied consent to send you information deemed pertinent by Checklick.

We will not disclose any of the Personal Information you provide to us when you contact us.

How Do We Share Personal Information?

Your Personal Information may be viewed and modified by:

  • Checklick staff.
  • Organization managers and their evaluators belonging to an organization with which you are affiliated, where your profile has been tagged as affiliated with that organization.
  • Organization managers and their evaluators belonging to an organization for which you are an evaluator, where your profile has been tagged as an evaluator for that organization.
  • Our third-party payment processor, Stripe.

Stripe is a PCI Service Provider Level 1, which is the highest grade of payment processing security.

For organizations utilizing Checklick Storefront, Stripe has access to information pertinent to processing:

  • Customer credit card charges.
  • Customer credit card refunds.
  • Linking past charges to Storefront orders in Checklick.

Specifically, Stripe only knows the Checklick order number, the Checklick Storefront organization’s name, the cardholder’s email address, the card number, the card expiry date, the card CCV, and the cardholder’s postal code or ZIP code. No names or dates of birth are ever transmitted to Stripe.

Your Personal Information may be viewed, but not modified, by:

  • Organization managers and their evaluators that have created checklists on Checklick and by whom you have been evaluated.

As described above, the privacy of your Personal Information is partly determined by which, if any, tags have been applied to your profile.

You may, at any time, remove any “affiliated with” or “evaluator for” tags, which will revoke the relevant organization’s ability and permission to access your Personal Information.

To revoke any other organization’s ability and permission to access your Personal Information, you must contact us and ask us to completely remove all of your Personal Information from Checklick.

In addition to the paragraphs above, we will disclose Personal Information to a third party when we believe in good faith that such disclosure:

  1. Is required by law, including, for example, to allow us to comply with a court order or subpoena; or
  2. Is necessary, in our opinion, to:
    • Enforce our policies;
    • Protect your safety or security, including the safety and security of property that belongs to you;
    • Investigate improper use of the Site, our other websites, our Applications, or our Services; and/or
    • Protect the safety and security of our Site, websites, Applications, or Services, or the sites or services of third parties.

In addition, if Checklick is to be sold, merged, or amalgamated, or is to sell or dispose of substantially all of its assets, any Personal Information may be transferred to a potential purchaser if, and to the extent, necessary for the purposes of deciding whether to proceed with the sale and completing the sale.

If such sale, merger, acquisition, or disposal is completed, the purchaser may use and disclose Personal Information only to the extent described in this Policy if the information relates solely to carrying on the business or activity, or carrying out the objects for which the sale, merger, or acquisition took place.

We may share anonymous, aggregated demographic information we have about users of our Services with our partners, advertisers, and other third parties. This information is not linked, and cannot be linked, to any Personal Information that can identify an individual person.

How Do We Store Personal Information?

The computers and servers on which we store and process Personal Information are kept in a secure environment.

These computers and servers may be located in countries outside of Canada, including the United States, and may therefore be subject to different laws than those applicable in Canada.

While we aim to protect your Personal Information when it is transferred outside of Canada, the laws of other jurisdictions may require the disclosure of your Personal Information to governmental authorities under circumstances that are different from those that apply in Canada and that are contemplated under this Policy.

We will store and retain Personal Information until we are required by law to remove it, or until we receive specific instructions from you to remove it.

Personal Information that has been anonymized and aggregated is no longer considered Personal Information, and we will retain such anonymous, aggregated information indefinitely.

We offer our users choices regarding our collection, use, and sharing of Personal Information.

If you receive any electronic communications, including emails, from us, you may indicate a preference to stop receiving further electronic communications by contacting us directly using the contact information provided below.

You can do the following at any time by contacting us via the email address or phone number provided on our Site, or through the contact information below:

  • See what data we have about you, if any.
  • Change or correct any data we have about you.
  • Ask us to delete any data we have about you.
  • See what Personal Information, if any, has been made available by us to our affiliates, subsidiaries, related organizations, or third parties.
  • Tell us to stop contacting you.

If you contact us to do any of the things listed above, we may require you to provide sufficient Personal Information to allow us to identify you and tell you about the existence, use, and disclosure of your Personal Information.

This Personal Information will only be used for this purpose. If you contact us about your Personal Information, we will respond to your request within a reasonable time and at no cost to you.

Does This Policy Apply to Third-Party Websites?

The Site and our other websites may contain links to third-party websites. Any Personal Information you provide on linked pages or other websites is provided directly to that third party and is subject to that third party’s privacy policy.

This Policy does not apply to such linked pages or other websites, and we are not responsible for the content, privacy practices, security practices, or policies of these websites or any other sites linked to or from our Site or other websites.

We encourage you to learn about the privacy and security practices and policies of these websites before providing them with Personal Information.

What Steps Do We Take to Protect Your Information?

We take measures designed to protect all Personal Information in an effort to prevent loss, theft, misuse, unauthorized access, disclosure, alteration, copying, modification, and destruction of Personal Information.

We provide physical, organizational, technological, electronic, and procedural safeguards to protect the Personal Information we process and store.

However, despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against interception or any other type of misuse.
